SERVICE TERMS AND CONDITIONS:

Terms and Conditions For the purpose of these terms and conditions Mexican Auto Service Inc., also doing business as Auto Club of Mexico, will be referred to as M.A.S. By purchasing M.A.S. prepaid services, you (the customer) are acknowledging having read, understood and agreed to the following service limits and conditions. M.A.S. will provide emergency roadside assistance on a 24 hour basis in Mexico. It is understood that this service plan will terminate on the date of expiration. Services are non-transferable to other vehicles.
Service Package Plans: for passenger vehicles, motorcycles, SUV's and trucks (no vehicles over 3.5 tons), M.A.S. will provide two (2) roadside assistance calls and one (1) tow of up to 200 Miles in Mexico. Towing back to the U.S. at no additional charge can be provided only if the customer is with in 200 miles of the U.S. Mexico border. If the customer is further than 200 miles in Mexico and wants the vehicle towed into the U.S., a $6.00 dollar per mile charge plus a $250.00 dollar charge international crossing fee will be charged to the customer.
A Service Call: is defined as a battery jump, flat tire change, emergency gas, lockout service (no keys made) and water for radiator. Flat tire/s will be changed with spare tire provided by customer. M.A.S. services do not include repairs to flat tire/s. It is the customer's responsibility to make sure that their vehicle has a useable spare tire. Only 2 gallons of gas will be provided for vehicles.
A Tow: is defined as the transport of a vehicle from one location to another.
M.A.S. Services will be denied under the following: when vehicle is in border line to enter the U.S.; vehicle does not have proper and current registration documentation, owner or responsible party for the vehicle is not present, intentional, unlawful or fraudulent actions are committed or are suspected, customer or members of customer's party are drunk and or disorderly, vehicle is stuck or disabled in any off road conditions, any requests for services outside of the service coverage area or when service package has expired.
Towing Restrictions: M.A.S. will not tow trailers, or any vehicle with a trailer. M.A.S. will NOT tow vehicles for; flat tires, damaged or missing tire/s, dead or missing batteries, lockouts, missing or damaged keys or out of fuel. Towing will only be provided for mechanical failure.
Accidents: M.A.S. will not provide towing in case of an accident or incident that involves the covered vehicle, since these incidents (and related charges) are covered by the corresponding Mexican insurance that the vehicle must have. However if the customer requests such a service, even in the case of an accident or incident, M.A.S. will coordinated and send the appropriate towing service at the customer's expense.
Towing into the U.S.: Towing into the U.S. from Mexico is limited to the restrictions of the Immigration and Customs Enforcement (ICE) and the hours of operation at each U.S. Mexico border crossing. Towing in to California from Baja California is available on a 24 hour basis. Towing into Texas, New Mexico and Arizona from Mexico is limited to the hours of 7:00 A.M. to 6:00 P.M. Towing into the U.S. thru all points of entry may be limited to the secondary inspection station on the U.S. side, due to Immigration and Customs Enforcement (ICE) restrictions. In cases that the customer needs to be towed back to the U.S., M.A.S. service providers will only tow the vehicle back across to the nearest international border. M.A.S. service providers can only transport two passengers in the tow truck. The person responsible for the vehicle must ride with the tow truck and all other persons in customer's party are responsible for their own transportation, at their own expense. The customer is responsible for the vehicle and will be held liable for all contents of or in vehicle. M.A.S. its employees, any of its agents, re-sellers or web sites, will not and cannot be held responsible or liable in any manner for the following: negligence, telephone malfunctions, injury, robbery, trauma or death to customer, and or members of customer's party, damage caused by fire, water, acts of vandalism, terrorism, civil unrest, civil disobedience, acts of God, if vehicle is lost or stolen, lost, stolen or damage of personal property belonging to customer or member of customer's party, arrest or imprisonment by U.S. or Mexican authorities of customer, or members of customer's party, fines imposed, tickets, impoundment, seizure, forfeit or detention of vehicle, any and all out-of-pocket expenses, lost time incurred by customer or members of customer's party as a result of any of M.A.S. services. Claims for any and all damages, injuries, personal loses to the customer, the customer's vehicle or anyone in the customer's party, suffered in Mexico are to be litigated in Mexico and will not be transferred to the jurisdiction of the United States. If vehicle is damaged by a service provider or the equipment, the damages must be settled with the customer and service provider prior to the release of vehicle. All services are provided by independent businesses, not employees or agents of M.A.S. however, M.A.S. will attempt to help resolve customer complaints.
